Ex-minister says UK Cabinet was “misled” about legality of Iraq war

Clare Short, the United Kingdom’s then-Secretary of State for International Development, appeared before the Iraq Inquiry yesterday, and told the panel that the Cabinet was “misled” about the Iraq War’s legality prior to the 2003 invasion. The three-hour session was held in the Queen Elizabeth II Conference Centre in London‘s City of Westminster.

Short, an outspoken critic of the war, retired from the cabinet to become an independent MP two months before the invasion. She claimed to have been “conned” into staying on despite her doubts about the war and told the inquiry that the Cabinet, of which she was a part, was not a “decision-making body”, and that Parliament was simply a “rubber stamp”.

She also claimed that Tony Blair “and his mates” had acted “on a wing and a prayer”, having “leaned on” then-Attorney General for England and Wales Lord Peter Goldsmith, pressurising him to change his mind about the invasion. She did, however, admit that she had no evidence to support these claims. Goldsmith gave a verdict that the war would be legal only shortly before the invasion, having firmly held the belief that it would not be without a further United Nations Security Council resolution.

Short was applauded as she concluded her testimony, in which she said that she was “shocked” at how a definitive statement about the legality of the war circulated only as late as March 17, 2003 — just three days before the invasion began — that this state of shock led her to be “jeered at” by other ministers. Said statement, according to Short, contained no hint that Goldsmith had previously had any doubts whatsoever.

She said any discussion of legality was stopped at the same pre-war cabinet meeting. She accused Blair of standing in the way of such discussion, and said, “Everything that’s happened since makes me know that there was deliberate blockage and there were also all sorts of secret, private meetings”, and that normal cabinet communications were “closed down” as the invasion approached. “There was never a meeting that said ‘what’s the problem, what are we trying to achieve, what are our military, diplomatic options?’ We never had that coherent discussion … never.”

Goldsmith responded to her inquiries about the lateness of this statement by saying “it takes me a long time to make my mind up”, and that he had made his decision after consulting foreign legal professionals. She said that Goldsmith’s “doubts and his changes of opinion” made her “think for the attorney general to come and say there’s unequivocal legal authority to go war was misleading.” She said that “I think he misled the cabinet. He certainly misled me, but people let it through”.

She claimed that the government, having failed to secure a required UN resolution, started the “untrue” rumour that France had vetoed it. She said that she “believed them at the time. You don’t want to disbelieve your Prime Minister in the run-up to war and you want to believe the leader of your party. You want to be loyal”.

When asked why she had not resigned earlier than she did, she said that she “was conned” by Blair’s promises of a strong role for the UN in the reconstruction of Iraq, as well as more attempts to resolve the conflict about Israel. She said that she “thought that if we got a Palestinian state and a UN lead on reconstruction, that will be much better … I took a lot of flak for it. I still think, if we had done those things, it would have been a heck of a lot better.” She says that this lack of UN involvement in the post-invasion reconstruction effort was her main reason for retiring from the government.

Short said that she “was seeing the intelligence” about Iraq at the earlier stages of preparation for an invasion, but that in late 2002 “asked for a briefing… This just didn’t come and didn’t come… it became clear there was some sort of block on communications.” Apparently, the intelligence reports she say said that “Saddam Hussein didn’t have nuclear [weapons] … [he] would if he could but he was nowhere near it. It wasn’t saying there was some new imminent threat”.

Short asserted Blair’s evidence, given to the inquiry on Friday, was “historically inaccurate”, since “[t]here was no evidence of any kind of an escalation of threats” after the September 11 terrorist attacks on the World Trade Centre. This is contrary to Blair’s claims that attitudes towards the threat Iraq posed “changed dramatically” after the attacks, and that Saddam Hussein “threatened not just the region but the world”.

She said, “We could have gone more slowly and carefully and not have had a totally destabilised and angry Iraq. The American people were misled to suggest that al-Qaeda had links to Saddam Hussein. Everybody knows that is untrue – that he had absolutely no links, no sympathy, al-Qaeda were nowhere near Iraq until after the invasion and the disorder that came from that.” Short criticised the military for not meeting the obligations laid out for them, as an occupying force, by the Geneva Convention.

Lord Boyce, the former head of the British armed forces, said in an earlier hearing that officials from the Department for International Development — Short’s department — let their opposition to the war prevent them from cooperating fully with the rest of the government immediately after the invasion. Alistair Campbell, Blair’s former spokesman, said that Short had been “difficult to handle” in the run-up to the invasion, and that there was fear that she may leak pieces of information that she did not agree with. Lord Andrew Turnbull, former Secretary of the Cabinet, however, said that these concerns were unfair, and that minority voices had been unfairly pushed to the sidelines.

Hilary Benn, who took over Short’s post after her resignation, is scheduled to give evidence before the inquiry today.

Japan government panel urges reinterpretation of pacifist constitution

A Japan government panel met last Tuesday and is drafting a report aimed to urge Japan to loosen restrictions on participation in military combat — restriction of military to self-defense — imposed in its constitution since the end of World War II. They expected to finalize the report after April. North Korea reacted by calling the Prime Minister of Japan, Shinzo Abe, an “Asian Hitler” on Wednesday.

The government panel — fourteen members headed by Shunji Yanai, former ambassador to the US — sought ways to reinterpret the constitution on the grounds there was not enough public support for revising, or rewriting, the constitution itself.

Shinzo Abe said he was motivated to help keep international peace — by protecting other nations’ troops, which was beyond the scope currently allowed under the constitution. He interpreted it as a country’s right, commenting, “it’s about whether we can exercise this right that every country has”.

During the Tuesday meeting, Abe also expressed a concern that the country’s national security was not ready for potential regional conflicts: “Japan’s preparation for national security threats in the region is not sufficient. We must cover all the bases to protect the people’s lives and safety in any possible scenario”. Yousuke Isozaki, a security policy adviser to Mr Abe, said a revised military policy would strengthen Japan’s ties with allies, the US in particular.

The Korean Central News Agency, the official news agency of the North Korean government, commented in an editorial, saying Abe was trying to conjure up fears of North Korea using missiles or nuclear weapons to help justify expanding Japan’s military. The Korean Central News Agency were likening Abe to Hitler. The editorial followed a comment by Rodong Sinmun, the ruling party — Workers’ Party of Korea — newspaper, which described Abe as a “militarist maniac” last month. The reaction was also inspired by Abe’s visit to Yasukuni Shrine in December.

Under Japan’s pacifist constitution, the country has not been able to engage in militaristic combat since the end of World War II.

Commenters related the move to escalated tensions with China, who had set up an Air Defense Identification Zone over a part of the East China Sea, including Japan’s Senkaku Islands, in November last year.

Just Don T Do It

Sometimes, it feels good to be a nomad. Nomadic in the sense that when you feel you don t want your job anymore, you d call the local movers in Springdale, Arkansas and move on. The hippies did it for some time in the 70s, why can t we? Of course, this is an excuse for taking social responsibilities and contributing to a more stable self. But just the idea of going everywhere and anywhere with the help of movers in Arkansas just gives that feeling of more freedom.

Freedom comes with limitations and accountabilities. With regulations, freedom becomes lawless and anarchistic. But what about just doing the things that we want? Most of us get burnout once or twice. There maybe tips and tricks to overcome that I m through attitude. Sometimes, however, it s good to completely let go by saying I quit then calling an Arkansas moving company for a speedy Arkansas packing business.

Surely moving your heavy-duty equipment may frustrate you. You better call piano movers in Springdale, Arkansas for that. To escape that another responsibility, just let go of it. Let it be. You don t have to move your things always. The main point here is you moving, traveling, and living.

We always complain how our bosses give us a hard day, how the bills mess our budget, and how we have to save for the future. Well, just say no. Just say no to your boss, let the bills be, and spend your savings. When was the last time you went to a spa? Or flew to Singapore? Moreover, when was the last time you saw yourself in the mirror without a stress at the back of your mind?

Spend your money. Travel and get crazy. It s for your sanity s sake. Go out with your family. If you still have small kids, congratulations, you will make their days. If you got working kids, good luck. If you are alone, the better, right?

People put so much time and effort with the things that they don t want nor like to do. They need to support themselves today and their futures. Well, don t work too hard just to save money for the hospital bills or morgue. Don t deprive yourself from good healthy food while eating preservative-added instant meals every mealtime. Waste your money on yourself.

We are living in a world where human power is a demand being exhausted. We see the flow of money rolling everywhere. We are afraid of spending money to satisfy our materialistic needs. We fear that actions today will have grave consequences tomorrow. We always think that when we do better in our jobs, we will get promoted and have lots of money to spend. Only then we will be able to be satisfied.

This is not a call for anarchy. This is not an article about forgetting all responsibilities that society put on your back to carry. This is a message about being free once in a while. This is all about defying what the social stratification brought to human civilization. Not fearing what tomorrow brings. We will never be satisfied. Higher jobs won t make us freer. It will just entangle us to more commitment and more stress. For us, the only time that we are able to gain the right to enjoy more freedom from work is when we get promoted. Promotion and high ranks will not satisfy your needs. Unless you steal and cheat, then that s a different story.

Get a life, they say. It s true. We should get one for ourselves. Don t be too fearful of what tomorrow might bring. Stop being afraid of consequences. No better time than now to realize putting our wants over our needs. Only then that we will see that we need our wants.

Quit your job if you don t want it. Date someone else and move on from the pain of divorce. Go to concerts of your favorite metal bands. Buy a new car. Spend your money. Feel happiness and contentment. When you get all you want within your means, that s when you can confidently look behind at all your failures and securely look forward for a more meaningful life. When society gave us social responsibilities, it did not mean we have to choose it before self-satisfaction.

God or carbon atoms gave us life. It s up to us to give it meaning.

2008 Taiwan Designers’ Week shows potential of innovations

Vastly different from the YODEX, mainly focused on students’ designs, the 2008 2nd Taiwan Designers’ Week, a collective show organized by Taiwan Designers’ Web for industrial designs and individual design studios, took place at the Xinyi Public Assembly Hall, formally known as “Si-Si Nan Cun (in Chinese: ????)” and entitled the theme of “Design & Beyond”.

This professional exhibition featured topical designs including “Play with the Eating Culture”, “Wall”, “The Story of Paper-Cutting”, “Basket”, “Between On and Off”, “50 Pleasures in the Study – Dian Shin Refreshment 2008”, “Reincarnation”, and “NoName Design”, at Xinyi Public Assembly Hall; “City Yeast 2008?Balcony Project” at Xue Xue Institute from June 26th to July 8th; “Having A Perfect Life Is Easy” at Taipei Artist Village from June 27th to July 7th. In addition, The XRANGE Studio also created a giant floating cloud at Central Square of Xinyi Public Assembly Hall.

Innovative designs in this exhibition showcased different topical elements on environment, modern lifestyle, current incident, and subculture. Those reflect the achievements by professional designers in Taiwan as Taiwan’s designs were affirmed in several international design competitions including G-mark, Red Dot, and iF.

After this exhibition, Taiwan Design Center, the show co-organizer, scheduled several upcoming competitions and shows from this August to October including “Taiwan Design Expo”, “Taiwan Design Award”, “Taiwan International Design Competition”, and “Creative Taiwan”.

Sweden’s Crown Princess marries long-time boyfriend

Sweden’s first royal wedding since 1976 took place Saturday when Crown Princess Victoria, 32, married her long-time boyfriend and former personal trainer, Daniel Westling, 36. The ceremony took place at Stockholm Cathedral.

Over 1,200 guests, including many rulers, politicians, royals and other dignitaries from across the world, attended the wedding, which cost an estimated 20 million Swedish kronor. Victoria wore a wedding dress with five-metre long train designed by Pär Engsheden. She wore the same crown that her mother, Queen Silvia, wore on her wedding day 34 years previously, also on June 19. Victoria’s father, King Carl XVI Gustaf, walked Victoria down the aisle, which was deemed untraditional by many. In Sweden, the bride and groom usually walk down the aisle together, emphasising the country’s views on equality. Victoria met with Daniel half-way to the altar, where they exchanged brief kisses, and, to the sounds of the wedding march, made their way to the the silver altar. She was followed by ten bridesmaids. The couple both had tears in their eyes as they said their vows, and apart from fumbling when they exchanged rings, the ceremony went smoothly.

Following the ceremony, the couple headed a fast-paced procession through central Stockholm on a horse-drawn carriage, flanked by police and security. Up to 500,000 people are thought to have lined the streets. They then boarded the Vasaorden, the same royal barge Victoria’s parents used in their wedding, and traveled through Stockholm’s waters, accompanied by flyover of 18 fighter jets near the end of the procession. A wedding banquet followed in the in the Hall of State of the Royal Palace.

Controversy has surrounded the engagement and wedding between the Crown Princess and Westling, a “commoner”. Victoria met Westling as she was recovering from bulemia in 2002. He owned a chain of gymnasiums and was brought in to help bring Victoria back to full health. Westling was raised in a middle-class family in Ockelbo, in central Sweden. His father managed a social services centre, and his mother worked in a post office. When the relationship was made public, Westling was mocked as an outsider and the king was reportedly horrified at the thought of his daughter marrying a “commoner”, even though he did so when he married Silvia. Last year, Westling underwent transplant surgery for a congenital kidney disorder. The Swedish public have been assured that he will be able to have children and that his illness will not be passed on to his offspring.

Westling underwent years of training to prepare for his new role in the royal family, including lessons in etiquette, elocution, and multi-lingual small talk; and a makeover that saw his hair being cropped short, and his plain-looking glasses and clothes being replaced by designer-wear.

Upon marrying the Crown Princess, Westling took his wife’s ducal title and is granted the style “His Royal Highness”. He is now known as HRH Prince Daniel, Duke of Västergötland. He also has his own coat-of-arms and monogram. When Victoria assumes the throne and becomes Queen, Daniel will not become King, but assume a supportive role, similar to that of Prince Phillip, the husband of the United Kingdom’s Queen Elizabeth II.

A Special Report From Siim 2010

At SIIM 2010, Herman Oosterwijk discussed issues that deal specifically with PACS connectivity. He outlined the following problems:

  • Network Issues: A well defined and managed network infrastructure is essential. Proper IP addressing and port number assignment has to be done. Duplicate IP addresses can create issues and are not always easy to troubleshoot. In case this is suspected, a netscan utility will show all IP addresses and potential duplicates. Note that DICOM devices rely on fixed IP addresses, as almost none of the PACS vendors make use of the dynamic configuration capabilities defined by the DICOM standard. Dynamic IP addressing is fine as long as the router does not re-assign them to a different address, e.g. when being re-booted or replaced. Note also that DICOM has an official assigned port number, i.e. port 11112, which is more reliable than the often used well-known port 104.

Not necessarily falling under the network but related is the need to manage AE titles making sure they are also unique. Realize that some devices have multiple AEs with potential different AE titles. Incorrect net mask definitions and/or VLAN specifications might make certain destinations unreachable. A rather frequent occurrence is the incorrect setting of the switch, e.g. to half duplex or mismatching the device setting, especially when auto-negotiating is configured. Switch issues result in major performance issues and can only be made visible when using a network sniffer.

  • DICOM Header Issues: The DICOM image header is generated through mapping RIS data, generation of the modality and manual input by a user. Either one of these sources can potentially generate incorrect and/or invalid data in the image header. Problems are unfortunately not always detected. For example, an incorrectly identified study might be archived in the PACS and get lost, only appearing when the data is migrated, which could be years later. Some PACS systems are more conservative than others and check every attribute, while other are more liberal and dont necessarily complain. A header with an Institution ID exceeding the maximum length of that field might be stored by vendor A while being rejected as an invalid image when being migrated years later.

In this particular instance, the Institution ID could have been mapped from the RIS using a worklist, while not checking for any length violations (note that the source of the data, i.e. the HL7 data elements might not have the same restrictions). Missing and/or incorrect patient demographics can be caused by the RIS being down, or a technologist not using the worklist. This will cause a study to be unverified or broken at the PACS. Some PACS applications sort and display images according to image and/or series number instead of according to slice orientation and body part causing the images to be displayed in the incorrect order. When retrieving comparison exams, one can run across some of the older date and time formats in the header, which might cause issues as well.

  • Hanging Protocol Issues: Hanging protocols not working is almost always related to incorrect header information or the wrong interpretation of the headers. A common mismatch is related to the way CR and DR systems organize their images into series. Some create a new series for each view (e.g. a Chest PA and LAT), some group them together in a single series. If the viewing software can only be configured to show different series next to each other, there will be some really unsatisfied radiologists. Another frequent issue occurs when some modalities modify automatically series and study descriptions, not taking the values from the worklist and therefore causing these descriptions not matching the hanging protocol configurations at the view station.
  • CD import issues: These issues almost always can be traced back to non-compliance with the DICOM standard and/or corresponding IHE profile. Frequent issues are the absence of DICOM image files because the vendor is only providing their proprietary format, a missing directory file, mismatch of the so-called meta-file header with the actual data content, incorrect transfer syntaxes such as compression, and several others. A recent issue has also been splitting up studies over multiple CDs. In many cases, one can convert the images to an acceptable format that can be imported; however, in some cases it is impossible to read the proprietary information, causing a repeat exam. One also need to make sure that patient identifiers are replaced, including the Accession Number otherwise the integrity of the PACS database could be compromised.
  • SOP Class support: Modalities are eager to support new SOP Classes as they contain more information and allow for better viewing and processing. PACS systems traditionally lag with their support for this new functionality. The most common mismatches are due to non-support of the PACS for the enhanced CT and MRI SOP Classes, Structured reports, such as generated by CAD devices and Ultrasound units for measurements, and for new specialties such as ophthalmology, dentistry and endoscopy. In most cases, a modality can be defeatured to fall back to an older SOP Class, or alternate encoding (e.g. burn in the CAD marks into a secondary capture), in some cases, one will be stuck with the proprietary information (e.g. MRI spectroscopy).

Swiss canton of Appenzell Innerrhoden fights back after invasion of German naked hikers

A local Swiss government has shown some bare cheek and has taken action, after hordes of German naked hikers rambling across the Swiss alps au naturel, caused indignation amongst locals.

Authorities in Swiss canton of Appenzell Innerrhoden have warned that starting from February 9, the government will impose hefty fines of 200 Swiss Francs (£122, €135) on naturists found walking or hiking in the nude without clothes in the picturesque mountains because of a recent influx of visiting German nudists.

The new ordinance is expected to be passed this spring. If it is approved by the local parliament on February 9 it should be effective on April 26. The Swiss canton aims to stop spread of ‘indecent practice’ by minimally-clad German climbers.

The problem started with a group of “boot-only hikers” who were stopped by the police in the Alpine region last autumn. They had wandered there regularly, proudly marching through nature with bare bums, and had also advertised what they thought was a naked paradise on the internet. But it was all too much for the Swiss.

A nude rambler dressed in nothing more than a rucksack and walking boots in the eastern Appenzell region was arrested and detained in the canton, but authorities were unable to file lawsuit because the act was not punished by law or ordinance at the time.

“We were forced to introduce the legislation against this indecent practice before the warm weather starts,” Melchior Looser, the canton’s justice and police minister, said. “Ultimately, in the summer lots of kids stay in our mountains,” he added.

In the guidelines imposed, arrested offenders who cannot pay the fine, will face legal action. The new enabling ordinance has, however, been met with protests by nude hikers. “We simply try to tune into nature. It’s the most harmless pursuit possible,” said Dietmar, age 58, a German lawyer.

German tabloid Bild Zeitung has editorially attacked Swiss intolerance and even suggested nudist alternatives worldwide, after hinting a Swiss tourism boycott. Local authorities of Harz mountain range in central Germany have also announced the openness to any visitor of an “official naked walking route” in nature’s outdoors.

Freikörperkultur (“FKK”), or “free body culture”, is a popular pastime in Germany. It is a German movement which endorses a naturistic approach to sports and community living. Behind that is the joy of the experience of nature or also on being nude itself, without direct relationship to sexuality. The followers of this culture are called traditional naturists, FKK’ler, or nudists.

The naked ramblers have hoped it doesn’t lead to another naturist-clothed ‘war’, like the one at a beach between German and Polish holidaymakers in 2008. Naturism has roots traced from the start of the 20th century. “Abandoning unpractical clothes enables a direct contact with the wind, sun and temperature”, naked hiker website nacktwandern.de stated.

But Markus Dörig, a spokesman for Appenzell Innerrhoden canton has defended the law, explaining that the “public nuisance” was a foreign import. “We have been receiving many complaints. The local people are upset and we in the government share their concern. How would one feel if one was to go walking in nature and suddenly came across a group of naked people? They are definitely not people from the area, and I think many of them come from Germany,” he noted.

“We are a small and orderly community and such things are simply out of place here. Perhaps in vast mountain areas naked people would not be much of a problem but here they simply stick out,” Dörig added. “I can understand that we all have to live in this world together,” said Barbara Foley, International Naturist Foundation member of the central committee. “But I would certainly enjoy doing the hike in the nude and I wouldn’t want to be deprived of it. It’s nice to feel the sun on your skin. Maybe they should designate a couple of trails and people would know they might come across naturists there,” she added.

Appenzell Innerrhoden (Appenzell Inner Rhodes) is the smallest canton of Switzerland by population and the second smallest by area, Basel-City having less area. The population of the canton was 15,471 as of 2007, of which 1,510 (or 9.76%) were foreigners. The canton in the north east of Switzerland has an area is 173 km². It was divided in 1597 for religious reasons from the former canton Appenzell, with Appenzell Ausserrhoden being the other half.

Appenzell is the capital of this canton. The constitution was established in 1872. Most of the canton is pastoral, this despite being mountainous. Cattle breeding and dairy farming are the main agricultural activities: Appenzeller cheese is widely available throughout Switzerland. Due to the split of Appenzell along religious lines, the population (as of 2000) is nearly all Roman Catholic (81%), with a small Protestant minority (10%).

The town, however is far from liberalism: the canton granted women the right of suffrage only in 1990 under pressure from the Federal Supreme Court of Switzerland and international human rights groups. The Alpine village of Appenzell Innerrhoden, being known for its beautiful landscape, has recently been declared a “naked rambler paradise” by a German mountaineering website, which was created by a lobby group of hikers.

Visa seeks to issue largest IPO in US history

Visa, Inc. announced on February 25, 2008 that it would soon go ahead with a much-anticipated initial public offering (IPO) of about half its shares. This would make it the single biggest IPO in United States history, according to the regulatory filing the company made. Visa hopes to raise about US$17-19 billion, emulating its main rival, MasterCard Inc., which successfully put out an IPO in 2006.

Shares are expected to range from $37 to $42 each. Visa is banking on a changing global economy which relies less on liquid cash and more on credit. Revenue at both Visa and MasterCard has climbed as consumers pay for more purchases with credit and debit cards, instead of cash. Analysts have suggested that current economic conditions, the sub-prime mortgage crisis and the weakening dollar, may leave investors skeptical about Visa’s potential earnings. However, as both Visa and MasterCard charge fees for transactions made with their cards and do not actually give credit, they avoid the current credit crunch and possible defaulted loans. Nonetheless, a slowdown in consumer spending would hurt the revenue stream of both Visa and MasterCard.

The two other main competitors, American Express and Discover, operate their own credit-lending networks and could therefore be vulnerable to credit risks.

Greek lawmakers approve contentious campus police legislation

The Greek Parliament passed contentious legislation on Thursday allowing for the creation of a campus police force and disciplinary council to end the tradition of violence at Greek universities. The decision, passed 166–132 in a parliament of 300, was opposed by many students and professors, who claim it would stifle freedom of expression.

Changes proposed included establishment of a campus police division, restriction of entry into university grounds, and formation of a “disciplinary council” empowered to suspend or expel students.

A Ministry for Citizen Protection spokesperson called university campus violence “timeless”; and said “[t]he police will drive out extremist political groups and guard the infrastructure, finally making the university a safe place”.

Prior to the vote, Greek Prime Minister Kyriakos Mitsotakis, leader of the centre-right New Democracy political party which first introduced the legislation, told lawmakers “[n]owhere in the world do we see images […] of historical buildings being vandalised”.

Many incidents of unrest have occurred at Greek universities, including a 1973 student revolt at Athens Polytechnic against the 1967–1974 military junta. The government forcefully repressed the uprising, resulting in the death of at least 26. Due to another protest in 1990–91 against high school reform pushed by Mitsotakis’ father Konstantinos, one teacher died. In October, a rector was taken hostage by hooded anarchists.

In 2019, the government repealed a restriction in place since 1982 that had effectively prevented police from entering university grounds.Opponents of the introduction of police at universities have described it as stifling freedom of expression, which the government claimed is “ridiculous”. At recent demonstrations, protestors have chanted “Bread, education and freedom”, a common anti-junta slogan of the 1973 uprising. In January, Athenian police used tear gas to break up a protest which was defying lockdown restrictions.

Many Greek professors have also opposed the idea, with Professor of State Theory and Law at Panteion University Dimitris Kaltsonis claiming, in remarks to Euronews, “there is no need for special police to control the campuses”. Oxford University’s University and College Union (UCU) stated on Twitter “its solidarity to Greek colleagues […] opposing the creation of such a special university police force, which is unlikely to respond to the most pertinent problems of Greek higher education institutions”, and that the then-proposal was “alarming and not in line with best practice.”

Some recent demonstrators have called for “more doctors, fewer police”. Eurostat data from 2016–2018, which a spokesperson for the Ministry for Citizen Protection called “inaccurate”, showed Greece had the second most police officers per capita of any country in the European Union. The spokesperson said the government is “investing in the quality of education as well”, but emphasised “[p]olice on campuses is not a choice, but a necessary move”.

€23 million was recently budgeted for Greek law enforcement to better “face contemporary challenges, such as COVID-19 and external threats”.

Left-wing opposition party Syriza has criticised the legislation as an attempt to make universities “sterile and unfree”.

Mahindra & Mahindra Ltd approved a scheme of demerger of the Two Wheeler undertaking of Mahindra Two Wheelers Limited and transfer and vesting thereof as a going concern into M&M.

Mahindra & Mahindra Limited (M&M) is the listed company, engaged in the business of sale of tractors, general purpose utility vehicles, light commercial vehicles, three wheelers and trucks and buses.

M&M entered the motorcycle market in 2013 to become a full-fledged two-wheeler major.

Mahindra Two Wheelers Limited (MTWL) is the company into business of manufacturing and selling of two wheelers and trading in spare parts and accessories.

MTWL is a subsidiary company of Mahindra Vehicle Manufacturing Limited (MVML) and MVML is a wholly owned subsidiary company of M&M.

RATIONALE

M&M

In line with its strategy to focus on two wheeler segment, this transaction would help to make benefit from design & Development and sourcing capabilities of the company.

MTWL

It would help the company to focus on spare business only in cost-effective manner. Besides, demerger will be in the interest of minority shareholders, in particular.

Step 1 Reorganisation of Share Capital

MTWL will write off the aggregate book losses (i.e. balance in Profit & Loss Account on 30th September 2016 and the additional debit balance in P&L Account i.e. the excess of assets over liabilities transferred shall be debited to reserves (Balance in Profit and loss Account).

The amount of Carry Forward Losses as on 30th September 2016 is Rs.2663.69 Crores.

The aggregate book losses as on 30th September 2016, shall be adjusted against the securities premium account aggregating to Rs 7.42 crores.

Balance will be written off by way of re organisation of issued, subscribed and paid-up equity share capital of MTWL. This will be done by reducing paid up value of equity share capital of Rs.10 each to Rs.0.02 each.

Consequent to the re-organisation, Losses will be reduced to NIL and Issued, subscribed and paid-up share capital of MTWL will be as under,

The consideration of the demerger will be issued as follows by M&M to MTWL; For every 461 shares fully paid up equity shares of MTWL (demerged company), 1 fully paid up ordinary of Rs.5 share of M&M (resulting company) will be issued.

For this purpose, the share capital of MTWL before re-organisation will be considered.

Structure

MTWL is subsidiary company of Mahindra Vehicle Manufacturing Limited whereas around 7.5% stake is held by outsiders

As mentioned above Mahindra Vehicle Manufacturing Limited is WOS of M&M, therefore MTWL is Step down subsidiary of M&M.

Thus, in the course of demerger, Shareholders of step down subsidiary will get the shares of the listed holding company. That is subsidiary MVML will get share of holding Company M&M.

Analysis

MTWL is running into losses for past 3 years.

Company also laid off the jobs to bring cost in control in the year 2016. During this, the company gave Voluntary retirement scheme to 250 people as Budgeted Sale Volume could not be achieved by the company.

After this cost cutting, MTWL is reorganising the capital to eliminate the losses followed by this demerger.

ACCOUNTING TREATMENT

MTWL:

The excess of assets over liabilities transferred shall be debited to reserves. In the case of deficit, the same shall be credited to capital reserve.

M&M:

The accounting of assets and liabilities will be done as per pooling of interest method laid down in IND AS 103 (Business combination of entities under common control).

Consideration issued to the shareholders shall be credited to share capital account at a nominal value of the equity shares. The deficit/ surplus arising after recording all the entries will be transferred to Capital reserve.

M&M PRESENT & FUTURE

Present

In 2015-16, Mahindra Two Wheeler saw sales declined by 12.7 percent at 1,33,355 units.

Its motorcycle sales also declined by 60.72 percent to 3,940 units from 10,031 units in the year 2015-16,

There is substantial in decrease in sales this year also and as mentioned above demonetisation worked as ad on in existing decline.

Future

Mahindra & Mahindra, the group’s automotive arm, in September partnered with Indian ride-sharing firm Ola to drive sales of cars, and also to use some of the data on drivers and rides to influence the cars it designs in the future.

Mahindra wants to enhance a greater start-up culture within the group, looking to foster new businesses which will complement its existing products and services.

Investments in start-ups will be made primarily via Mahindra Partners, the group’s venture capital that already has several start-ups like Trringo – a farm equipment and tractor rental business and Smart Shift – an Uber equivalent for small goods carriers.

M&M said they would look for technologies and products which would benefit the group’s existing companies.

Goenka, The Executive Director of M&M said the company’s plans is to focus on the Mojo motorcycle and the scooter model such as Gusto 125 which is doing reasonably well.

CONCLUSION

Mahindra & Mahindra has acquired UK-based two wheeler BSA Co. for Rs. 28 crores and also consolidation of two-wheeler business in M&M, which is inline its strategy to expand in two-wheeler business. Through the scheme arrangement, the company has right-size its balance by adjusting losses.
