On November 16, code-sharing and hosting service GitHub re-enabled the public access to youtube-dl repository, a software which can download videos from the internet via the command-line. This move comes after Mitchell Stoltz, a Senior Staff Attorney of the Electronic Frontier Foundation (EFF), sent a letter to GitHub on the behalf of youtube-dl’s maintainers. The repository was previously blocked on October 23, after GitHub received a Digital Millennium Copyright Act (DMCA) take-down notice from the Recording Industry Association of America (RIAA).

Started in July 2008, youtube-dl is a free/libré open source software written in Python which can download videos from various websites. Citing alleged violation of 17 U.S. Code § 1201 Circumvention of copyright protection systems, RIAA’s takedown notice had alleged youtube-dl was intended to circumvent the technological protection measures of streaming services and to redistribute music videos without authorisation. youtube-dl’s source code had a number of unit tests to check if the software works in different circumstances or not. Some of the test cases included URLs of some copyrighted songs.

In the letter to GitHub, EFF’s attorney Stoltz said “This file contains series of automated tests that verify the functionality of youtube-dl for streaming various types of video. The youtube-dl source code does not, of course, contain copies of these songs or any others […] the unit tests do not cause a permanent download or distribution of the songs they reference; they merely stream a few seconds of each song to verify the operation of youtube-dl. Streaming a small portion of a song in a non-permanent fashion to test the operation of an independently created software program is a fair use.” The letter stressed “youtube-dl does not decrypt video streams that are encrypted with commercial DRM technologies”.

The URLs to copyrighted songs were removed from the source code on November 16, and replaced with a test video that uploaded on YouTube by Philipp Hagemeister, former maintainer of youtube-dl. Philipp Hagemeister had previously spoken about the takedown with Wikinews.

youtube-dl comes with a small JavaScript interpreter where it acts as a web-browser would behave while receiving video data from the server. The script has “extractors” for various websites to handle videos from different sources. “Any software capable of running JavaScript code can derive the URL of the video stream and access the stream, regardless of whether the software has been approved by YouTube”, the letter read. It borrowed an analogy of Doors of Durin from J. R. R. Tolkien’s Lord of the Rings for explanation: travelers come upon a door that has writing in a foreign language. When translated, the writing says “say ‘friend’ and enter.” The travelers say “friend” and the door opens. As with the writing on that door, YouTube presents instructions on accessing video streams to everyone who comes asking for it.

Hours after the public access was restored, Sergey M, one of the maintainers of youtube-dl wrote on GitHub, “We would like to thank @github for standing up for youtube-dl and making it possible to continue development without dropping any features. We appreciate [GitHub] for taking potential legal risks in this regard. We would also like to thank [EFF] and personally [Mitch Stoltz] for invaluable legal help. We would also like to heartily thank our main website hoster Uberspace who is currently being sued in Germany for hosting our essentially business card website and who have already spent thousands of Euros in their legal defense.”

Hours after GitHub restored the public access to the repository, Stoltz tweeted “I think of youtube-dl as a successor to the videocassette recorder. The VCR empowered people to take control of their personal use of free-to-air video, but it had to be saved from the copyright cartel. The same goes for youtube-dl. GitHub did the right thing here.”

youtube-dl is used by thousands of people around the world. Multiple Creative Commons-licensed and public domain videos on Wikimedia Commons are uploaded via a tool called video2commons, which relies on youtube-dl to download media. youtube-dl also lets users download videos from LiveLeak — a video-sharing platform for citizen journalism. Videos downloaded using youtube-dl are also used for the purpose of fair use, or for evidence. When a copyright holder chooses to release their work, be it a photograph, a video, or audio, under a Creative Commons Attribution (CC BY) license, they allow everyone to freely own, share or modify the work as long as the reusers properly attribute the author of the work. YouTube also hosts many audio and video recordings in the public domain which can be used for any purpose without any restrictions.

In the blog post announcing “youtube-dl is back”, GitHub said, “Although we did initially take the project down, we understand that just because code can be used to access copyrighted works doesn’t mean it can’t also be used to access works in non-infringing ways. We also understood that this project’s code has many legitimate purposes, including changing playback speeds for accessibility, preserving evidence in the fight for human rights, aiding journalists in fact-checking, and downloading Creative Commons-licensed or public domain videos.”

GitHub also announced any new 1201 takedown notices will be “carefully scrutinised by legal experts” to reject “unwarranted claims”, and said it will side with software developers if the claims are ambiguous. The announcement also mentioned GitHub Trust and Safety team would treat developer’s tickets as a “top priority”. GitHub also pledged donation of USD 1 million for developer defense fund “to help protect open source developers on GitHub from unwarranted DMCA Section 1201 takedown claims”.

GitHub had blocked public access to many forks of youtube-dl upon receiving the DMCA notice in October. Wikinews notes public access is not yet restored for the forked repositories listed in RIAA’s copyright notice and still displays “Repository unavailable due to DMCA takedown”.

During the period when GitHub had disabled public access for the repository, Sergey M had been developing youtube-dl and hosting it on GitLab, another code-sharing and hosting site. However, since GitHub has restored public access of youtube-dl, Sergey M has made the GitLab repository private.

After this, Wikinews reached out to Richard Stallman, the founder of Free Software Foundation, who has been highly critical of DRM (digital rights management, the subject of the DMCA) for many years now, to discuss the harms of DRM and DMCA 1201.

Livingstone brands Boris ‘a joke’ in London mayoral elections

On the final day of campaigning before the vote in the London mayoral election, incumbent Ken Livingstone attacked main rival Boris Johnson as “a joke”. He warned Londoners that they were not voting in a “Celebrity Mayor” contest.

Livingstone unveiled a campaign poster in West Ham that will also be printed on postcards and sent to one million Londoners. It reads: “Don’t vote for a joke. Vote for London.”

“It’s not an election for the host of Have I Got News For You or a celebrity mayor. It’s about who is best placed to run an £11bn budget every year,” Mayor Livingstone said, referring to the panel game show, for which Boris Johnson has been a guest host.

“Tomorrow you have a choice between new policies and fresh energy from a new mayor in City Hall or more of the same from a tired, out-of-date administration that is beset by allegations of sleaze,” responded Johnson in a mass e-mail to over 500,000 voters. “I am optimistic about London’s future and believe we can make London a greater place to live in.”

London will be voting for mayor tomorrow, May 1. Ken Livingstone is the candidate for The Labour Party and Boris Johnson is the candidate for the Conservative Party. There are a number of other candidates, but recent opinion polls have shown it to be a two-person race, with some polls predicting a victory for Livingstone and others Johnson.

Chancellor Rishi Sunak announces UK budget 2021

Chancellor of the Exchequer Rishi Sunak announced the UK’s 2021 budget on Wednesday in the House of Commons. This comes amid significant damage to the country’s economy from the COVID-19 pandemic, in which over 700 thousand people have lost their jobs, with the economy shrinking by 10%.

Sunak announced an extension of the furlough scheme, which had been paying employees who could not work due to the pandemic 80% of their wages. He said it would be extended until September. The scheme also mentioned firms would have to pay 10% of this in July, and 20% in the months of August and September as the scheme ends. It was also announced that support for self-employed people would continue, with another grant for between February and April.

Other support for workers included the minimum wage increasing to £8.91/hour from April, and an existing £20 weekly increase in Universal Credit being extended through September.

Sunak also announced some changes to taxation in the country, with corporation tax rising to 25% in April 2023. Sunak said that this would be the lowest rate in the G7, and that businesses would only be taxed if they made profits of over £250 thousand, which is only 10% of companies. Companies with profits of less than £50 thousand will continue to pay 19% corporation tax. Sunak said that income tax, national insurance, and VAT would not change in this budget with alcohol and fuel duty continuing to be frozen.

For hospitality firms, VAT will continue to be frozen at a reduced rate of five percent. The contactless payment limit will be increased from £45 to £100 this year. New freeports were also announced in locations at East Midlands Airport; Felixstowe and Harwich; Humber; Liverpool City Region; Plymouth; Solent; and Thames and Teesside. These would allow reduced customs costs, and encourages investment.

Texas woman accused of shooting landlord dies in hospital

A woman died of a self-inflicted gunshot wound Wednesday, around 10:00 local time at East Texas Medical Center in Tyler, Texas.

The woman, Alice Alvarez Aguilar, 46, was found by police Tuesday morning on the floor of her apartment. The police were called to Ms. Alvarez’s apartment around 12:30 pertaining to a report of gunshots. When they arrived, they found Ms. Alvarez’s landlord, Socorro Nunez, 70, dead due to gunshot wounds in an adjacent apartment.

Witnesses say they heard Ms. Aguilar and Ms. Nunez arguing over a guest when the gunshots fired. Reports state that Ms. Nunez’s two sisters arrived after police. Acquaintances of Ms. Aguilar reported she was experiencing financial troubles, which may have caused the incident.

Neighbors and friends expressed shock at the event. An acquaintance of Ms. Aguilar, requesting anonymity, said it was unbelievable. “I saw [Ms. Aguilar] almost every day… She was a nice lady, just a regular person.”

Wikinews interviews Stephen Murphy about the upcoming by-election in the Higgins electorate of the Australian parliament

With two by-elections coming up in Australia, many minor parties and independents will be looking to gain a seat in the House of Representatives. Stephen Murphy is one of the independents.

Mr Murphy is a computer programmer from the Melbourne suburb of Brunswick.

“After growing up in South-East Melbourne I studied Science at Monash with first class Honours, worked in Europe for 10 years and have recently returned to Australia. I work in finance as a computer programmer and speak five languages,” Mr Murphy said.

Wikinews reporter Patrick Gillett held an exclusive email interview with Mr Murphy, candidate for the Division of Higgins.

((WN)) Why do you want to get into parliament?

Stephen Murphy: I am standing up for what I believe is the correct course of action on the biggest issue in Australian politics in 100 years – Kevin Rudd’s flawed emissions trading scheme (ETS).

((WN)) What would the three main policies you are taking into this by-election be?

SM: I will oppose the emissions trading scheme, ensure that all government policy is based on accurate scientific evidence and return common sense to Canberra

((WN)) How would you address these policies?

SM: By asking for a Royal Commission into climate change so that the facts (such as that global warming stopped in 2001 and the emissions trading scheme will not change the climate one bit) are openly presented to the Australian people.

((WN)) Sending asylum seekers to Indonesia: good or bad?

SM: Any government policy that does not properly consider all implications (be it emissions trading, or any other issue) is a bad one.

((WN)) Is the Australian dollar’s near parity with the US dollar a sign that the Australian economy is healthy, the US economy in chaos or both?

SM: It’s a sign of both. Many countries around the world look with envy at how well (relatively) Australia is doing, to our credit! It is of concern that the American economy is in such bad shape and that their levels of debt seem unsustainable.

((WN)) How do you rate the governments economic stimulus package?

SM: The economic stimulus package was poorly targeted and poorly carried out. When we could have been building roads, dams, railways and hospitals yet instead we were paying for tattoos, PlayStations and overseas holidays.

((WN)) Should it be wound back?

SM: The question about levels of stimulus spending is a complicated one and requires expertise in economics, however one could say in general terms that all government spending should be well targeted and spent in the most efficient way.

((WN)) Is Kevin Rudd a better Prime Minister than John Howard?’

SM: Australian voters are the best judge of that and we will know in 2019 🙂

((WN)) Is the Carbon Pollution Reduction Scheme an effective solution to climate change? Why?

SM: Absolutely not. The CPRS will not change the climate by any amount that we can measure – it’s just a new tax that will hurt Australians and drive businesses and jobs overseas. Since 2003 there has been mountains of new scientific data which contradicts the popular theory that human carbon dioxide emissions are causing significant global warming. Recently, many of the scientists who wrote the IPCC report (on which the ETS / CPRS is based) have been reported as manipulating scientific data to create scary global warming scenarios. The science is definitely not settled

((WN)) Is there a better solution?

SM: We can very easily refocus the momentum and goodwill that has been generated on climate change and channel this energy into other worthwhile environmental projects in Australia that will make a difference.

((WN)) Why should the electorate vote for you?

SM: I will oppose the ETS and support responsible environmental policies instead of radical environmental policies that could end up costing every Australian taxpayer $4550 per year in new taxes.

Ex-US soldier sentenced to life in prison for Iraqi teen rape, four murders

A former US soldier has been sentenced to life in prison for raping a teen and murdering her and her family while on active duty in Iraq. The jury failed to reach the unanimous verdict required for the death penalty sought by the prosecution.

According to testimony given by two soldiers, Steven Dale Green was part of a group who decided they wanted to rape a girl they had seen walking through her village, 14-year-old Abeer Qassim al-Janabi. They walked to her house while disguised as insurgents and separated her from her parents and younger sister.

Green then shot dead Abeer’s family while two other soldiers raped the girl. He then raped her himself while she wept before covering her face with a pillow and fatally shooting her. The gang then covered her naked body with a blanket soaked in kerosene, using a lighter to start a fire before walking 200 yards to a nearby checkpoint where they cooked a meal.

Green had already been discharged from the army when his crimes were discovered. He had previously spoken of a desire to murder Iraqi civilians and his defence argued he should never have been allowed to return to duty. A nurse had decided he would not carry out his desires. A US civilian court tried him, the first such prosecution of a soldier under a law allowing servicemen to be charged with crimes carried out abroad.

The judge described his actions as “unimaginable, unjustified and inexcusable” and sentenced him to five consecutive life sentences without possibility of parole. Four others had already been sentenced. Three are all serving life with parole after ten years, and a fourth who acted as a lookout is serving a 27-month sentence.

It took months for the offences to be discovered, even though Green had quickly confessed to a sergeant. Soldiers speaking to stress counsellors talked of the crimes after the abduction and murders of two other soldiers. When news of the soldiers’ actions broke, insurgents killed several American servicemen in revenge.

The prosecution described Green as “criminal and perverse” while the defence called him a “broken warrior.” Green said he was acting upon orders from former Specialist Paul Cortez, another of the attackers, and told the court “Y’all can act like I’m a psychopath or a sexual predator or whatever. But if I had never gone to Iraq I would never have got caught up in anything like this.”

If you’ve been diagnosed with celiac disease, your doctor probably advised you on the many foods and food ingredients you must avoid. Definite no-no products are those made with wheat, rye and barley, the popular gluten-bearing grains found in many breads, cereals, pastas, crackers and other baked goods.

Gluten also lurks in other less obvious places such as luncheon meats, salad dressings, yogurt, malt vinegar, soy sauce, many flavorings, and gravy and sauces thickened with flour.

People with celiac disease experience a severe immune reaction to gluten — the protein in wheat, rye and barley that can inflame the lining of the small intestine and interfere with the body’s ability to absorb nutrients and minerals. When you can’t get the nutrients your body needs, health complications arise.

Rice products — dietician-approved for celiac sufferers

Rice flour is one food ingredient you can eat without fear, since it contains no gluten. Compared to other gluten-free grain products, enriched rice flour is also a relatively nutrient-rich ingredient you can include in your gluten-free diet.

But which is better for you — brown rice flour or white rice flour? Is there a significant difference in nutritional value?

Brown rice flour explained

Brown rice flour is made from finely ground whole-grain rice. This slightly tan-coloured flour has a nutty flavor and is higher in fiber and nutrients than white rice flour. This is good to know, since people with celiac disease often need to supplement their nutrient intake, especially with folate, iron and dietary fiber.

What is folate?

Folate (an important water-soluble B vitamin) is especially critical for fetus development, which is why pregnant women especially should have this nutrient during and after pregnancy.

Adults should have at least 400 micrograms of folate daily and for women, at least 600 micrograms during pregnancy. One cup of brown rice flour contains 25 grams of folate versus 5 grams of folate in one cup of white rice flour.

White rice flour

As the name implies, white rice flour is made from ground white rice, and contains no bran or polish (the part of the layer under the rice bran) thus is lower than in fiber and nutrients than brown rice flour. White rice flour contains less folate than brown rice flour.

(By way of note, glutinous rice flour is also known as sweet, sticky, or sushi rice flour. It’s made from sticky short-grain rice that is higher in starch than brown or white rice. Like brown and white rice flours, glutinous rice flour doesn’t contain gluten either.)

Rice flour and fiber

Although our bodies don’t break down fiber, it plays an important role, particularly through our digestive system. Fiber helps us maintain regular bowel movements.

Consuming adequate amounts of fiber is especially important for people with celiac disease, but especially those newly diagnosed individuals who may have symptoms of diarrhea caused by gluten damaging the small intestine.

Comparison-wise, the dietary fiber of brown rice flour is more than double the amount found in white rice flour.

In summary: While all rice products are good for people who are celiac or suffer from gluten-intolerances, foods and snacks made with brown rice flour are better than white rice flour.
